Nevada state plan for independent living. 18:02:48 I'm going to start out by telling you a little bit about what this is in case you don't know. 18:02:55 The statewide Independent living Council we seek public comment for our proposed amendments to our current State Plan for Independent Living. 18:03:07 We're responsible for developing a new SPIL for every three years for the next three years period, which since it's already been approved and in place, it's from federal fiscal year '25 through federal fiscal year '27. 18:03:21 That means it runs October through September of -- October of 20 -- I'm getting myself confused here -- 2024 through September 2025. 18:03:38 That's fiscal year '25, and then through fiscal year '27, which ends September 30th of -- 18:03:50 September 30th of 2027. 18:03:55 Sorry. 18:03:56 Anyway, we have an approved state plan, but because we had it approved prior to the last legislative session in which we had asked for some legislative funding that did not get approved, we do have to go back and make the amendments. 18:04:11 And so that's what this session is about. 18:04:15 There's gonna be a couple of other things that we've proposed to change, and they're very minor. 18:04:22 One of them being a different approach to how we're looking at our medical community for the disability community, I'm sorry, the medical staffing for the disability community and how that works. 18:04:38 We've had -- been lucky enough this last fiscal year, in fiscal year '26, to have the national council on Independent Living award the state of Nevada a grant that specifically addresses accessibility issues in medical establishments. 18:04:56 So the Centers for Independent Living as well as our counsel has gone ahead and executed our recommendations for upgrades on accessibility in our medical facilities through Centrum across the state. 18:05:16 So that's something that we did update, and we're now including in our state plan instead of what we had originally planned, which would have been duplicative. 18:05:28 . 18:05:29 The fiscal changes that we're asking for are mostly having to do with staffing. 18:05:35 Because we did not get the staffing funding that we had hoped for, we have to go back and change our state plan to reflect those changes in our budget. 18:05:46 And so as you may be aware, we're moving -- we have become, since we started the state plan, we have become a 501(c)(3). 18:05:58 We're in the process of making decisions about how we should move forward and what that looks like for our council, and so we have included some of that information within our state plan as far as our budget planning goes. 18:06:18 One of the things we were hoping to do, we were actually given the green light for, which was receiving innovation and expansion funding from vocational rehabilitation in fiscal year '27. 18:06:32 So if and when that happens and we're able to coordinate with Aging and Disability Services, as our designated state entity, to make sure that we're able to receive that funding in a timely manner during the fiscal year, if not we'll have to wait until the next state plan, but if we are able to coordinate it, we wanted to make sure we were writing that into our amendment as well to allow for that. 18:07:02 So that is one of the other differences as well. 18:07:09 If there are any questions or concerns, thoughts, considerations, ideas, I mean, you have an idea, I want to hear it. 18:07:22 The council wants to hear it, and I know there's a lot of councilmembers here present, but if you have ideas, this is a good time to state them as well. 18:07:31 So I'll go ahead and stop talking now and allow you guys to go ahead and speak up if you need to, or if you would like to. 18:07:49 Steven. 18:07:50 >> Steven Cohen: I noticed in a quick perusal that the educator funding went from specific to general. 18:08:00 Can you kind of walk me through -- because kind of a lot of folks need, leg folks, ADSD does not appear to have a dedicated person right now because I guess Geron left or whatever, but can you kind of walk me through how to divide that up. 18:08:25 Dawn Lyons: So let me make sure I'm understanding your question, because I didn't think we changed anything from the currently approved SPIL in that regard. 18:08:36 >> Steven Cohen: It went from a specific amount to generalized that there will be a position. 18:08:49 Dawn Lyons: Oh, I can't recall why we did that. 18:08:51 But at the top of my head, it just sounds like something that was a wise decision just because we don't want to limit ourselves in any way, and it's mostly up to the centers for independent living how they want to manage that since they're going to be the ones who are coordinating that. objective 1-A, indicator 2. 18:10:24 The SILC will set aside community ILE funding each year for collaborative legislative education initiative to be conducted by all the IL network together during the interim and Nevada 84th session and into the beginning of the 85th session. 18:10:41 >> Steven Cohen: Correct. 18:10:42 Dawn Lyons: I remember now because I think it was either Lori or Cheyenne, one of you two, at the time noticed that I had written in the incorrect legislative session, and so we had to change the session number because it would have been the next following session and we wanted it to be within this current SPIL. 18:11:02 >> Steven Cohen: But the change, if you look in yellow -- 18:11:07 Dawn Lyons: Yes. 18:11:07 >> Steven Cohen: The amount of funding. 18:11:09 Dawn Lyons: And I don't think that that was necessarily the reason why we changed it, but we did -- I did also change that language to be less specific so that it was less restrictive. 18:11:21 But yeah, that was the original reason why we had to change that. 18:11:25 That's why I didn't even recall. 18:11:27 But thank you for bringing that up. 18:11:30 >> Steven Cohen: And for number three right below that, you didn't get any new staff, so that needs to be updated as well unless it meant the educator person. 18:11:49 Dawn Lyons: You know what, to be honest, I'm not sure what we meant by new stafff". 18:11:57 Because it may be the centers for independent living were telling me that they would have new staff. 18:12:03 Dedicated to that. 18:12:04 Or maybe what they meant was they would bring legislative educator on as staff. 18:12:10 But that is a good point, and I'm going to highlight that because I think I probably need to change that language to state that the IL network will educate at least three legislators and policymakers. 18:12:28 How's that sound? 18:12:29 That way it's not all on one person. 18:12:31 >> Steven Cohen: Yep, that works. 18:12:33 And kind of my thought, kind of picking up on bullet point number two would be to just -- 18:12:39 unless there's a reason, would be to have all budgetary language be vague, because otherwise you're going to pigeonhole yourself. 18:12:53 Dawn Lyons: Well, we can't have all the budget information vague because the main reason why we have to do our amendment is because our budget has changed more than 10% of what we had planned, and that's a rule that ACL gives us. 18:13:08 So we do have to have our budget spelled out but the budget that includes the legislative educator, we just didn't micromanage it. 18:13:17 We just didn't drill down is all. 18:13:19 >> Steven Cohen: Got it. 18:13:22 Because kind of my thought -- 18:13:24 maybe it's a co-question for Lori would be kind of granted it's somewhat confidential at this point, but what is being brought forward while there are pending decisions? 18:13:41 Are we renewing the request for additional staff, or how is that looking in GovRec. 18:13:53 Dawn Lyons: Oh you mean regarding the staff that we did never get the funding for? 18:13:57 >> Steven Cohen: Correct. 18:13:58 Dawn Lyons: Yeah, no, because we are in transition into deciding what our nonprofit status will look like in the next state plan. 18:14:07 We wanted to allow for room to make that decision during this current amended SPIL. 18:14:16 And that was kind of one of the things I was talking about when I said we added language in accordance with that to transition and leave it up to the council to make those types of executive decisions about how they wanted to move forward with that and if they wanted to do private staffing rather than state staffing or what they wanted that to look like in fiscal year '27, once they receive INE funding from voc rehab. 18:14:46 >> Steven Cohen: And for number four, this is right below again, the two below, the educator one. 18:14:53 Dawn Lyons: Okay. 18:14:53 >> Steven Cohen: Do we want to pigeonhole ourselves to the categories that are listed there? 18:15:03 I'm assuming you're talking emerging needs is what that's intended to be, because I don't think emerging needs kind of -- 18:15:11 there's emerging need every five seconds now pretty much. 18:15:14 Dawn Lyons: Well, technically, so what we did during fiscal year '25, we utilized -- what we did with that $20,000 for emergency funding was we included it in our fiscal -- 18:15:35 third-party physical agent's funding, and that way we held it aside just in case, and we ended up using it for a specific urgent need for the IL network at the end there. 18:15:46 So we did end up using it. 18:15:50 That's not -- of course we will end up likely using it every year for different reasons, depending on what comes up. 18:15:59 But we wanted that in there basically because of what happened during COVID and all the unexpected added expenses that we had for extra meetings and things that we didn't anticipate based on that emergency. 18:16:11 So we wanted to make sure we had a little bit of a cushion in case there was some type of emergency situation that arose. 18:16:21 >> Steven Cohen: So it lists housing, employment, transportation and mental health. 18:16:26 That was my question. 18:16:26 Do we want to pigeonhole ourselves to those categories. 18:16:30 Dawn Lyons: I see what you're saying. 18:16:32 Yeah, that was something that came up as the most likely to cause urgent situations. 18:16:41 And I think that they're broad enough that if an emergency arose under any of those categories, that's what we're looking at mostly. 18:16:54 And I see what you're saying, but I know that the CILs really had a lot of input on that and those were the main things that they usually come across that they need additional funding for. 18:17:08 >> Steven Cohen: Got it. 18:17:10 And is number five John's program, is that what that means, in English? 18:17:16 Dawn Lyons: Yes. 18:17:18 >> Steven Cohen: Okay. 18:17:28 Dawn Lyons: Oh, no, I'm sorry, number five actually states SILC will provide 30,000 in federal fiscal year in '25 and 113,000 to support community IL services and CIL separations in federal fiscal year '26 and '27. 18:17:47 So those are to the network. 18:17:50 >> Steven Cohen: Got it. 18:17:51 Dawn Lyons: To the network. 18:17:54 >> Steven Cohen: Got it. 18:17:56 And the reason why it was so much smaller in fiscal year '25 was because we had more going towards John's program, I believe, at that time. 18:18:12 >> Steven Cohen: Got it. 18:18:13 I'll ask as a follow-up to that, the elephant in the room question, because I know network is the centers for independent living, the SILC and the network of partners. 18:18:41 So they fall into the network because they fall into the category of network of partners. 18:18:49 >> Lyons: If you come up with any more, let me know. 18:19:11 >> Steven Cohen: For 1C, I was reading somewhere further down that it is the position that I was originally going to hold and then Cody did. 18:19:21 Is that going to be discontinued? 18:19:25 Is that correct? 18:19:27 Dawn Lyons: Yes. 18:19:28 So we will no longer be hiring a contracted state employee for the youth outreach specialist position. 18:19:39 It's just been problematic since day one. 18:19:43 There's been a lot of issues with it, and we have had a hard time with retention. 18:19:50 People would be hired on and then they'll leave shortly after. 18:19:55 It's just been kind of a nightmare, to be honest. 18:19:59 And so we discussed it and thought that it might be better, especially since we're a 501(c)(3) now, that if we're able to provide a stipend for youth action councilmembers who are able to do some of the work themselves and take leadership roles, that that might work better for us. 18:20:20 >> Steven Cohen: Okay. 18:20:22 It addresses I think 1C would have to be stricken, basically. 18:20:28 Dawn Lyons: Well, no, because we're still collaborating with and providing ongoing support for youth transition services, employment and education. So that's the objective 1-C. 18:20:45 >> Steven Cohen: Got it. 18:20:47 Dawn Lyons: And I didn't actually change anything in there in that section because it's mostly about our support and our partnership with the TRIP program through the Department of Education. 18:20:59 >> Steven Cohen: Got it. 18:21:11 Dawn Lyons: With all the people that we told about this forum or this town hall, I was hoping more people would show up and have questions and give us ideas or thoughts. 18:21:20 But I know there will be a few people that provide written comments. 18:21:24 So that will be good and I can share that the next SPIL workgroup meeting or the SILC or both. 18:21:33 But hopefully -- I mean, I'm going to sit on here until 7:00 p.m. because that's how long we said we'd be here, just in case someone else shows up and they couldn't get here until then or until five minutes to the hour or whatever. 18:21:50 But so far, Steven, you've got all the questions. 18:21:55 If anyone else does, please speak up. 18:22:00 >> Steven Cohen: For 2A, number three, and then 5, for 3, would it potentially be even if it's a subcommittee of the board rather than having to manage two separate nonprofits is the way I read that, to have a youth section of the board of the SILC. 18:22:26 Margaret, I don't know how you feel about that one. 18:22:28 Dawn Lyons: That's not the idea behind it. 18:22:33 The idea behind it is to allow the youth action council to piggyback off of the ideas from our main council if they choose to do so. 18:22:43 I'm not going to push them into becoming a nonprofit if they're not ready or if they don't want to. 18:22:50 But if that's something that would like to explore, I wanted to make sure it was in our state plan that I could help and assist them with that process since I'm going through that now with our council. 18:23:02 >> Steven Cohen: Got it. 18:23:03 And then number five, I think kind of the employment first coalition disbanded, unfortunately, so we probably should address that in some way. 18:23:12 Dawn Lyons: It did. 18:23:15 But I think we still were planning -- well, it's okay. 18:23:21 It just because it didn't work out the way we expected it to, because things didn't turn out the way we had hoped because they didn't go -- they started to go in the direction we wanted to, wanted it to, and then things kind of came to an abrupt halt, for reasons that we don't need to know necessarily. 18:23:45 But because it did, we really weren't able to accomplish that goal, but that doesn't mean it wasn't one of our goals or that it shouldn't be recorded as one of our goals because that's what we had intended. 18:23:57 So I left it there even though we didn't accomplish that goal in 2025, we can explain that in our report, our annual report as to why. 18:24:09 >> Steven Cohen: Got it. 18:24:13 Can you briefly address new number six, the nickel barrier removal fund is what I'm reading. 18:24:19 Dawn Lyons: Yes, so that's the grant that I was talking about that the national council on independent living awarded to Nevada. 18:24:26 It was Nevada in another state who got the awards for the IL network to go ahead and go into medical facilities through Centrum-run medical facilities because that's where the grant was coming from. 18:24:41 And recommend or take applications for improvements and accessibility for each of those and then review them and determine which ones were the ones that were necessary, and so the grant is a $50,000 grant. 18:25:01 And so between all of the medical facilities, we were able to make recommendations based on the applications as to what was appropriately spent under that $50,000 grant. 18:25:16 >> Steven Cohen: Got it. 18:25:20 Dawn Lyons: A lot of really great improvements, actually. 18:25:23 >> Steven Cohen: And then for 2B, number 4, are there any plans to re-engage SEI or somebody else, especially now with what's going on with Olmstead? 18:25:40 Dawn Lyons: Yeah, you know, we still have it on there to evaluate the current plan, to see if there's any recommendations that we have, or any concerns that need to be addressed or you know, if we feel like -- if we find another state that does something in a different way that's working well, maybe we could make that recommendation, but we just haven't really started that process yet. 18:26:04 >> Steven Cohen: Okay. 18:26:04 Dawn Lyons: But, yeah, we're still planning on doing that. 18:26:08 >> Steven Cohen: Got it. 18:26:11 And then for number 6, have you come across any state through Congress, SILC Congress or anything like that, that has tribal seats on the SILC itself. 18:26:29 Dawn Lyons: Yes, there are several states that have tribal seats. 18:26:33 I can't remember which ones off the top of my head, but I'm pretty sure Wisconsin is one of them. 18:26:40 And it's a challenge in Nevada, right? 18:26:43 But we wanted to at least do some outreach and make the effort. 18:26:57 >> Steven Cohen: And 3A, number 2, is that a reverse needs assessment contract, or is that what that's meaning? 18:27:16 Dawn Lyons: That was more or less an idea that someone had brought up at our last SPIL, when we were sorting through our last SPIL workgroup and getting suggestions from the public, that was one of -- I can't recall who made that suggestion, but I included it because I thought it was a good suggestion to at least explore the idea and see if it was something that would make an improvement in how we're evaluating our state plan. 18:27:43 Or if an outside source could do a better job because they're more objective, maybe, if any other states are doing that and what that looks like. 18:27:52 It was just worth exploring. 18:27:53 >> Steven Cohen: Got it. 18:27:54 And then conforming change for number 4, probably would be recommended to broaden the language for the degree of partners? 18:28:11 Dawn Lyons: Which one? 18:28:12 >> Steven Cohen: Number 3A, number 4. 18:28:15 Dawn Lyons: The federally funded part C centers will provide the SILC with current quarterly updates regarding services to consumers and consumer trends so the SILC has valid and current network data on the needs for individuals with disabilities. 18:28:32 >> Steven Cohen: Correct. 18:28:33 The question was to broaden it so that Dee Dee and Margaret don't feel left out. 18:28:39 Dawn Lyons: Dee Dee is not left out. 18:28:41 You know RCIL is always included in those updates. 18:28:45 But we're not as -- we don't -- 18:28:51 there's nothing in there that specifically says what data they need to provide us, other than sfzs to consumers and consumer trends, right? 18:29:08 So it's not like we're saying we want to know how many consumers, like, you know how John with the AT for IL program comes with his report and he gives us all the details and all the data, all the quantitative data along with his anecdotal information about how the program has been working, and he does such a thorough job, but it's not something that we necessarily need all of that information every quarter because we do get their approved report, annual report, as soon as it's approved by the F 18:29:39 They do allow us to look at those data, look at that data and those numbers and see those kinds of information at that time. 18:29:49 So we really just want to hear the anecdotal stories and see if it's an inordinately large number of people seeking a certain service, we want to hear about it. 18:30:04 You know what I mean? 18:30:05 We don't necessarily need to know, well, last month it was 50 people and this month it was 70. 18:30:11 >> Steven Cohen: Yeah. 18:30:12 Dawn Lyons: We want meaningful information is all I'm saying, and we don't want to spell that out too distinctively so that it seems like we're. 18:30:24 >> Steven Cohen: Nitpicking. 18:30:25 Dawn Lyons: Yeah. 18:30:25 >> Steven Cohen: Got it. 18:30:29 And then for 3C with the whole 501(c)(3) evaluation process, is SILC currently still EO only, or has there been any thoughts about putting it in statute? 18:30:56 Dawn Lyons: EO meaning? 18:30:57 >> Steven Cohen: Executive order. 18:30:58 Dawn Lyons: Thank you for spelling that out. 18:31:01 You do that to me and I'm always stumped whenever you throw me off about alphabet soup. 18:31:07 I'm like, I don't remember what that means. 18:31:09 Tell me what you're talking about. 18:31:11 But, yeah, we are established in executive order. 18:31:14 And we aren't looking to create any statutes that go further into detail at this time. 18:31:40 It's funny because in a past executive order before we had it redone by Governor Sandoval, but before that, when I started working with our council, a long time ago, our executive order said that we could be -- that we would be a 501(c)(3) and we were not. 18:31:58 And so I ended up having to change that and then we, of course, left it in as an option instead of a statement. 18:32:10 >> Steven Cohen: Right. 18:32:16 And in just looking at the nice little funding graphs, can you kind of address the whole I and E0 question that's addressed in the narratives? 18:32:34 The innovation and expansion, zero. 18:32:38 Dawn Lyons: Right. 18:32:39 It comes to fiscal year '27, that's where we added it in because that's when we're supposed to receive it. 18:32:47 >> Steven Cohen: I think you're right. 18:32:53 Correct. 18:32:54 Dawn Lyons: That's the main one I highlighted because that's the one I had to change the most because the salaries that we didn't get when we -- that we asked for at legislature and then the $50,000 I and E funding. 18:33:07 So all of that had to be changed and moved around to make the adjustments. 18:33:16 >> Steven Cohen: So is this just -- this is probably a silly question, but is this merely a narrative change, or is it a functional change? 18:33:31 Because with the exception of the budget, because you're saving the money but you're really not because you're putting the money that you would have otherwise allocated to those three potential positions to actual programming in some form or fashion. 18:33:54 Dawn Lyons: Correct. 18:33:56 And towards our own budget for any transitions we make for our status as a nonprofit. 18:34:10 It's within our network, yes. 18:34:13 But yeah, it is -- I mean technically our budget changes are functional changes because we didn't get the staffing that we were hoping to get. 18:34:26 So that does change quite a bit functionally. 18:34:46 >> Steven Cohen: And then I guess -- and I'm looking at below the '27 table, the second -- the $50,000 paragraph that I was talking about earlier on, what is the plan if VR doesn't play ball with that $50,000? 18:35:11 Dawn Lyons: VR has already agreed to it. 18:35:14 I just signed a memorandum of understanding with voc rehab to receive the I and E funding. 18:35:22 Now, it's contingent on approval of their amendment for their state plan because they had to amend their state plan and in that process that's why they were able to allow for 50,000 in I and E funding for SILC. 18:35:42 So as long as RSA still exists, that they approve their amendment, then that's why it's everything is a little bit up in the air, because as long as everything runs smoothly, we should get it in fiscal year '27, but if for some reason they don't even have an approval, we'll have to wait for that money. 18:36:01 >> Steven Cohen: Okay. 18:36:07 And then Section 3 below that, the list of organizations, is where I was talking about changing Lisa to Mark. 18:36:24 Dawn Lyons: Oh, yeah, thank you. 18:36:25 I'm going to highlight that right now. 18:36:29 >> Steven Cohen: And then below the map, DHS, not DHHS anymore. 18:36:39 Dawn Lyons: Below the -- 18:36:41 >> Steven Cohen: Below the map of Nevada, the county map. 18:36:44 Dawn Lyons: I think that's the centers for Independent Living section. 18:36:49 Let me scroll down. 18:36:51 Which part under there? 18:37:55 That I guess what other options do the CILs have to get out of underserved status, let me ask the question that way. 18:38:07 Dawn Lyons: It's not that they're an underserved status. 18:38:11 It's that -- I see what you're saying, though, they're not really -- they don't ever receive enough federal money to really serve the community the way we need them to. 18:38:23 But what we need is the data to back that up. 18:38:26 And so that's another reason or that's another thing that we wrote into our amendment for fiscal year '27 to provide a grant funding or subaward money to an organization who can do a needs assessment for us, which was awarded in our July meeting to Black Swan Consulting, and we're excited to get that started at the beginning of the calendar year. 18:38:49 >> Steven Cohen: Got it. 18:38:50 Dawn Lyons: I say calendar year because we have discovered over the past few years that when our fiscal year begins October 1st, we often don't receive our first, receive our first installment of our grant funding until at least December. 18:39:11 So we decided to push back since we can't really give anybody money that we don't have. 18:39:16 Most of our subawards have to wait until we get that funding, so we decided to just start them in January. 18:39:21 >> Steven Cohen: Got it. 18:39:23 And then 5.2. 18:39:27 What was saved by returning the state fund, which, by the way, the letterhead still has that number on it. 18:39:35 That's where I was questioning, if you remember. 18:39:38 Dawn Lyons: Let me catch up with you here. 18:39:45 SILC resource plan?
